1. Geltungsbereich und Anbieter

Diese Allgemeinen Geschäftsbedingungen (AGB) regeln die Nutzung der CardBase-Plattform (im Folgenden „Plattform“), die von CardBase, Schweiz (im Folgenden „Anbieter“) betrieben wird.

Mit der Registrierung oder Nutzung der Plattform erklären Sie sich mit diesen Nutzungsbedingungen einverstanden. Wenn Sie mit diesen Bedingungen nicht einverstanden sind, dürfen Sie die Plattform nicht nutzen.

2. Dienstleistungen

CardBase ist ein Marktplatz für Sportkarten sowie Sammelkartenspiele (TCG), wie insbesondere Magic: The Gathering, Pokémon, Yu-Gi-Oh!, Disney Lorcana, One Piece, und Flesh and Blood. Die Plattform ermöglicht:

  • Kauf und Verkauf von Sammelkarten zwischen Nutzern
  • Verwaltung persönlicher Kartensammlungen
  • Preisverfolgung und Marktanalyse
  • Community-Funktionen und soziale Interaktion

Der Anbieter tritt ausschliesslich als Vermittler auf und wird nicht Vertragspartei der zwischen den Nutzern abgeschlossenen Transaktionen.

3. Registrierung und Benutzerkonto

3.1 Voraussetzungen

To use the Platform, you must be at least 18 years old or have the consent of a legal guardian. Registration requires a valid email address.

3.2 Kontosicherheit

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized use of your account.

3.3 Kontoarten

The Platform offers the following account types:

  • Collector: For personal collection management and purchases
  • Private Seller: For occasional sales of personal cards
  • Commercial Dealer: For professional card trading (requires business registration)
  • Community Hub: For stores, clubs, and event organizers

4. Listings and Transactions

4.1 Listing Requirements

Sellers must provide accurate descriptions of card condition, language, and any defects. Prices must be stated in Swiss Francs (CHF) including any applicable taxes.

4.2 Condition Grades

The Platform uses the following condition grades:

  • Mint (M): Perfect condition, as new
  • Near Mint (NM): Almost perfect, minimal wear
  • Excellent (EX): Light wear, fully playable
  • Good (GD): Moderate wear, clearly visible
  • Light Played (LP): Significant wear
  • Played (PL): Heavy wear, still identifiable
  • Poor (P): Severe damage

4.3 Binding Transactions

Once a buyer completes a purchase, a binding contract is formed between the buyer and seller. Sellers must ship items within 3 business days unless otherwise agreed.

5. Fees and Payments

5.1 Platform Fees

The Platform charges a commission on completed sales. Current fee rates are displayed in the seller dashboard and may be updated with 30 days notice.

5.2 Payment Processing

Payments are processed through secure third-party payment providers. The Platform does not store credit card information.

6. Shipping and Delivery

Shipping within Switzerland is the default option. International shipping may be offered at the seller's discretion. Sellers are responsible for proper packaging to prevent damage.

7. Returns and Disputes

7.1 Return Policy

Buyers may request a return within 14 days if the item significantly differs from the description. The seller is responsible for return shipping costs in case of misdescription.

7.2 Dispute Resolution

In case of disputes, users should first attempt to resolve the issue directly. If unsuccessful, the Platform offers mediation services.

8. Prohibited Conduct

The following is prohibited on the Platform:

  • Selling counterfeit or replica cards
  • Fraudulent listings or misrepresentation
  • Harassment of other users
  • Circumventing Platform fees
  • Automated access or scraping
  • Any illegal activities

9. Intellectual Property

Trading card images and names are trademarks of their respective owners (Wizards of the Coast, The Pokémon Company, Konami, etc.). The Platform uses these for identification purposes under fair use.

10. Limitation of Liability

The Provider is not liable for transactions between users, including but not limited to lost shipments, damaged goods, or fraudulent sellers. The Provider's liability is limited to the platform fees paid in the past 12 months.

11. Termination

Users may close their account at any time. The Provider reserves the right to suspend or terminate accounts that violate these terms. Outstanding transactions must be completed before account closure.

12. Amendments

The Provider may amend these terms with 30 days notice. Continued use of the Platform after the notice period constitutes acceptance of the amended terms.

13. Applicable Law and Jurisdiction

These terms are governed by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.
